QUEENSBURY -- A Warren County grand jury has charged a Glens Falls man with murder in connection with the death of his girlfriend’s 5-year-old son and has filed two felonies against the mother as well.

Brandon M. Warrington, 24, faces felony charges of second-degree murder and second-degree manslaughter as well as a misdemeanor count of endangering a welfare of a child, according to court records.

Jennie M. Mattison, 23, was charged with felony counts of first-degree reckless endangerment and hindering prosecution and misdemeanor endangering the welfare of a child. She was the mother of victim Gary Carpenter III.

Both pleaded not guilty during arraignments before Warren County Judge John Hall on Tuesday morning and were returned to Warren County Jail. No new court dates were set.

During the arraignment, a prosecutor graphically outlined numerous serious injuries that occurred to the boy in the days before his death, which included an apparent sexual assault.

“This was an innocent 5-year-old boy who was brutally abused by the very people who were supposed to protect him,” Warren County District Attorney Kate Hogan said.

Authorities said the physical abuse happened on Thursday, but the indictment alleges the injuries occurred over a two-day period Wednesday and Thursday.

The murder count does not accuse Warrington of intentionally killing the boy, but alleges he acted recklessly and with “depraved indifference to human life.” He is accused of causing a fatal head injury.

Police videotaped more than 5 hours of questioning of Warrington, and the video was filed with the court on Tuesday

During the questioning, he told Glens Falls Police Detective Sgt. Peter Casertino and State Police Investigator Warren Law that he disciplined Carpenter after the boy slapped his face the night before. He said he pushed the boy several times, knocking him to a linoleum floor once and into a bedroom wall twice.

At one point, he used the word “rage” to describe his reaction, but repeatedly said he did not mean to hurt the boy.

“It was an accident,” he said. “The kid pissed me off.”

He repeatedly denied sexually assaulting the boy.

Video statement

Mattison’s questioning Warren County sheriff’s Investigators Mo Aldrich and Russ Lail was also videorecorded, amounting to more than 4 hours.

She told police there was a dent in the wall near Carpenter’s bed, which she believed was put there by the boy’s head.

She wept through much of the interview, at first minimizing her knowledge of the incidents and saying she didn’t witness Warrington hurt the boy.

Later she said she heard incidents where Warrington seemed to be hitting the boy in another room of their apartment, and saw Warrington slam the boy to the floor at one point. But she said she did not see Carpenter hit his head.

“I didn’t see it, I just heard it,” she said. “I asked him what happened and he said he didn’t know what happened.”

Later during the questioning, police urged Warrington to write a letter to Mattison as the two were being questioned Thursday, before Carpenter died.

“I never meant for any of this to happen,” he wrote. “I love that lil boy. I hope he is going to be OK.”

In Mattison’s letter back to him, she wrote that she had “told you that you can not correct him like (a) teenager or adult.”

“I don’t believe you intentionally did it but you really should have let me deal with him when you got upset,” she wrote, according to court records. “I really wish you would have let me deal with Gary then this wouldn’t have happened.”

During Mattison’s arraignment Tuesday morning, Warren County Assistant District Attorney Kevin Donlon outlined a horrific list of injuries the child suffered before his death, including a fractured skull, injuries to the genitals, rectum and neck and bruises to his arms consistent with restraints being placed on them.

The boy’s body temperature was 86 degrees and his lips were blue when he was brought to Glens Falls Hospital, Donlon said.

The couple put the boy in a shower and put vinegar under his nose to try to wake him up before 911 was called, according to court records.

His lips were blue when he was brought to the hospital, Donlon said.

“There were multiple injuries in all different stages of healing,” he said.

Hogan said the injuries that appeared related to a sexual assault were believed to be “fresh” injuries.

Mother's statement

Mattison is accused of endangering the child by failing to promptly seek medical help for the boy; police believe she waited for 30 to 45 minutes after Warrington left their home Thursday morning before she sought medical help.

The hindering prosecution count accuses her of lying to police about how Carpenter was hurt.

She initially told police that Carpenter apparently got hurt jumping on his bed, but later changed her story.

Carpenter was hospitalized Thursday with a serious head injury, and died late Friday night at Albany Medical Center.

Warrington was charged by police last week with felony counts of first-degree assault and first-degree reckless endangerment for allegedly injuring the boy, charges that were filed before his death. The indictment supersedes those charges.

Warrington is being represented by the Warren County Public Defender’s Office, and Public Defender John Wappett said he had no comment on the case Tuesday morning.

Second-degree murder is punishable by up to 25-years-to-life in state prison and felony reckless endangerment can bring a prison sentence of up to 7 years for Mattison. Hindering prosecution is punishable by up to 4 years in prison.

Mattison is being represented by Tucker Stanclift, who said he did not believe the reckless endangerment count was warranted and said case law has affected the viability of that charge in recent years.

“To suggest she has depraved indifference to her own child is absurd,” Stanclift said.

Billie Jo Rivers, a great aunt of the toddler, attended the arraignments and cursed Warrington as he left court. After the hearing, she said relatives of the boy suspected Warrington had been abusing the boy for a while and had made child abuse complaints about the situation numerous times in the past.

“There were multiple complaints about this, not just one,” Rivers said.

The Post-Star detailed prior child protective services and police investigations involving the family in an article in Tuesday’s paper.

Officials acknowledged Monday that Warrington was the subject of at least one child abuse complaint regarding Carpenter in the months before the boy’s death, but the boy remained in the couple’s custody.

Mattison gave birth to another son three weeks ago, and that child was in the custody of the Warren County Department of Social Services as of Tuesday.

    It is really endearing to read of all the citizens who seek justice for the offenders. It is wonderful that everyone wants justice and wants things to change in a better way for children. May I ask how we can accomplish better conditions for children?
    I believe we should start by developing a culture that embraces environments that children will thrive in. I find one of those environments to be the family unit, the old family unit whereby a couple didn't have children until they were married and had a legal commitment to stay together; an environment where responsibility is a major factor. It sounds old fashioned but traditional family units ( not with out problems ) were more stable and produced more stable children. The traditional family worked why not go BACK to something that worked. Our culture is tolerant to a fault and there's no way to rein in the harm being done by the new culture of polygamous or serial partner lifestyles; Children are victims of a broken culture!

    I not sure what Glens Falls Hospital or Albany Medical Center were suppose to do in your opinion with a 5 year old child that had a severe head trauma. Do you think the boy was better off alive-probably a vegetable for the rest of his life? Also, who says the mother isn't going to get jail time. Don't you think they are going to make an example out of this!? She was already on probation.

    CPS has to follow the law of the state. It is this liberal state that we live in that continues to allow this to happen. Sorry, but the family is to blame for this tragedy. The families that raised these two horrific specimans. Where were they when these children were being placed in hotels because they were homeless. Why did a family member not insist on taking these children until the sexual abuse charges had been determined?? We take abused animals away from their owners at the drop of a hat but our State laws continue to hinder CPS workers from doing their jobs when it comes to taking children away from their "families". Stop bitching about the local CPS workers and start complaining to your State representatives to have these laws changed!!!!!

    1st thing- I will pray every single day that this mother gets everything she deserves, as she was responsible for the safety of this little boy and deserves even more severe punishment than that actual killer!!

    2nd-So you must think every village, every town should have a hospital that can treat each and every possible situation?? From what you are saying above, we should have a hospital in Granville so no time is wasted coming to Glens Falls. You can not have a trauma center in every single town, you can not have a burn center in every single town, you can not have a NICU in every single town. Wishful thinking but certainly not logical!

    I agree with who say cps is worthless...they go after poeple who are not doing anything and give the one's who do a pat on the back.Really what is it there for we see this time and time again.I have seen it first hand been there.My four year old at the time had explained to a very strange thing that had happened to her....somthing NO 4 yr old daughter should ever know about.I went to cps for help.....what happened? i'll tell person pulled themself for knowing the person.I was told to get evidence for myself...which how could i,i couldn't just go into someone elses house.Then they had her draw pictures and they said their was something up.Well 2 weeks later they call me to tell basiclly to keep my mouth shut...that they weren't going to do anything.CPS doesn't do anything to help poeple who need it. R.I.P little gary

    Agreed wholeheartedly. It is hard to fathom that anyone no matter how old they are would beat a five-year-old to death because the child "pissed them off". It is also hard to fathom that the mother sat by and let it happen. That is accessory to murder in my opinion. RIP little Gary ... I am glad that the infant is in protective care. The woman should have her tubes tied as punishment and save all of us from having to read these haenous crime details!

    I agree with that sentiment Joehill. They did not care about the boy. The video of the mother's reaction to the desciption of the boy's injuries given to her by the police officer, indicate that she was apathetic to his medical conditon. The police told her the boy was not doing well and was in critical condition. They also told her he had been sexually abused. She continued to protect the boyfriend, not her son. She did not cry about her son.

    I understand when there are REAL concerns with respect for abuse but the problem there in lies with perception MANY people feel spanking is abuse... I do not when it is done CORRECTLY AND NOT IN ANGER....spanking is LEGAL in NY.... I for one feel that is what is impart with the coming up generation(I am in my 30's where parents still spanked) MOST kids have been taught everyone has to like them to be completely free thinkers( not respecting authority) and been given so many "choices" they think following the law is a CHOICE..Their actions have never HAD REAL consequences to their bad behaviors( or even illegal behaviors) until they are adults.... Parents need to teach their children values no matter what religion they are! Treat others with respect, respect authority even when you don't agree, don't like the authority LEGALLY fight it! Children are her because YOU made the choice NOT THEM! So stop acting like they are a burden( I see this ALL THE TIME) and start taking care of them!!

    Glens Falls Hospital is not a trauma or pediatric hospital. Why would you keep a critically injured patient, especially a child, at a hospital that is not equipped to treat that patient?

    possibly this entire county needs to re-evaluate the process. New laws need to be implemented as far as mandated reporters. all of us are mandated reporters, how many individuals honestly were questioning this childs safety in any way? and did nothing for fear of getting involved? In this case there were several reports of abuse, these reports must have been indicated as a result the infant was removed. so the very real argument regarding individuals that will lie make false acusations does not apply in this case, and so may previous high profile cases regarding these horric cases. I believe the laws related to child abuse should include prosecution of any individual that does not report a suspected child at risk. especially any adult that resides within the home, teachers, neighbors all family members must be mandated to report. I sincerely feel the human society does a better job at protecting abused animals. we hem and haw and these tragic events continue..

    The mother does not get jail time for this horendous act , she will have something hanging over her head, parenting classes and other counselings which is so sad. Warrren county obviously favor's the female's around here,And Glens Falls hospital needs to step up and hire the right Doctors/personal/staff to attend to patients with critical conditions, instead of putting the burden on Albany Med ,were Albany always receives a critical patient from Glens Falls, who on the following day die..Brandon Warrington should get the max, and the mother should get half of the sentence he receives, That's my opinion..

    ok i totally disagree with you! iam of this generation and would love to get my hands on these two! capital punishment should be available for this type of incident. how can you say the whole generation shouldnt have children. iam a father of 2 boys. you can ask them anything and they will tell you the truth. have i slapped butts ? yes but i dont beat a child.

    I am sorry this little boy died didn't know him but am close friends with a few that did I have four children( three with special needs)and would NEVER hurt my children! Would never let ANYONE HURT THEM... The thing I don't get is she let this child suffer for about 40 mins HOW THE HECK do you watch your child lying there and not do SOMETHING for them!? And in another note these people were grabbed up so quickly... Why was it not the same for the mother of the 7 week old when they have proof that she was aware(from text messages) that the baby was in danger!!!FOR OVER 3 days AND SHE DID NOTHING!!??? The "mom"ster of little Gary was almost snickering in her mug shot!? The boyfriend had the look of "whatever" and NOW THEY are crying hmm pretty fishy to me

    I am a single dad raising my son on my own.. To hear that a little boy had to go through what he did is so sickining..Two point's I have to make, Number 1. We all know that the mother in this crime will not face jail time, which is crazy,she will have something hanging over her head, that's about it, some parenting classes and other counseling, will be her sentence, which is sad.I find that so discriminating in this county, always favoring the woman.Number 2, When is Glens Falls Hospital going to step up and hire the right doctors/personal/staff to handle critical medical outcome's as these?? Flying babies, children,adults to Albany med. in these critical conditions is time being wasted,and what happens when these people in a critical condition get escort to Albany med?? They end up to die the following day..Why is this being discuss, some of these lives could be saved in Glens Falls Hospital, but no, Glens Falls sends these big problems down to Albany How sad..

    CPS is a joke...and so are the court systems in NY. My point in case 2 little girls were brought around a convicted sex offender TWICE...once in front of the family court judge...She got a slap on the wrist and an extra visitation day. Mark my words...their sentences will be reduced and the mother will get off with nothing but probation. Loop holes will prevail. R.I.P little man you're in the loving arms of God now...nobody can ever hurt you again.

    The Warren County Commisioner of DSS has failed to oversee CPS and DSS so when is New York State going to step in and review the atrocities toward children in Warren and Washington Counties? How many children must be killed or brutalized before they actually do their jobs and REMOVE THEM! No, they err on the side of the poor parent!
    Reunify, a nice word for a child’s right to be brutalized again. These parents are smart moving between counties, playing the system; DSS and CPS just pass the buck, and hide behind confidentiality. The last 4 horrific cases since 2009 have all had prior reports filed. 2 of those children are dead; what’s happening to the other 2? Anyone watching?
    Society owes every child the right to a good, happy, and protected life. Shame on you DSS and CPS for protecting the parent over the child!

    C.P.S. Assisted in the Murder this adorable child....They need to be looked in to...THEY dropped the ball, This child had been Sexually abused and there was record of it....WHY THE HELL he was STILL with these "people" NEEDS to be ANSWERED!!!!!!!

    This case is very similar to one that resulted in the conviction of Flint and Lewie, both being found guilty for the death of Lewie's son. I hope that there is the same outcome to this case. I am distressed that this has happened again to another child. I do not understand why she did not stop the abuse, or call for help for her son.

    I agree with stephgagne1990. She was just as bad as he was and should get the same charge as him. To many parents are getting away with letting there significant other do what they want to their child and not having to be as much at fault as the person doing the act wether it bit physically or emotional hurting the child or sexually abusing the child. I cant stand parents like that.

    I couldn't disagree more with the comment that "this generation shouldn't have babies." I know many people that are in their 20's who are great, loving parents! Once again, low lives like this have to make a bad name for everyone else! RIP poor baby, may you play with the angels in a safe place.

    When will CPS and the like face heavy scrutiny over these types of cases? I know the ultimate responsibility is not theirs but time after time you read that there have been previous reports against... I'm not saying they haven't done their best but why is it never investigated where the ball may have been dropped by officials who may have had warning signs?

    I do wish the police had not gone outside of standard evidence gathering procedures with the "letters". This may be a problem down the road. It would be disgusting to see either of them walk or face reduced charges because the police tried to trick them into testifying against themselves.

    This whole thing makes me sickened. First of all CPS did you guys check this little man's body when previous CPS reports were made. What about the kindergarten teacher (ever notice any marks) could all this slip through so many hands. Damn them for saying they loved that little star also states he had injuries to his genitalia and rectum WHAT went on in this house. God bless you Glen Carpenter III ! So sorry you had to go through all, that your poor little soul went through. And Brandon you will get your due when you get to prison, they love people that KILL children in there, but let that be only a 1/4 of your damned soul. Jennie Mattison your acting like you didn't do anything call that a mother....obviously you need to look that definition up your just as sick as your boyfriend..what part of your son's lips are blue and he isn't breathing and is twitching don't you comprehend of when to call should be charged with murder also!!!!

    There also need to be an investigation of CPS in this tragedy. It appears that they have been aware of this situation for some time but allowed the poor boy to stay with these "people." To say there is not enough evidence to take the boy is ridiculous; where there is smoke the is fire. The CPS worker responsible should be arrested if they dropped the ball on this one.

    How can any attorney want to defend people like this? There is a difference between one's innocence and manipulating the laws in order to obtain a not-guilty verdict. Shame, shame, shame on those who do the latter. The Karma Police will arrest you eventually.

    I so agree with you SGF Parent. That comment from Mr. Stancliff warrents nothing but anger from me personally! Any Loving, reponsible parent, would NEVER let this happen to their child!
    I thank God that her infant was taken away from her & I hope to God that she never gets that poor baby back. These acts on this poor little boy are so sickening!

    In response to sevenkitties, I can't disagree more. My girls are in this age group and are excellent parents. They have friends who have children also and are also excellent parents. As a family member of this little boy I'm sickened by what his mother and her boyfriend did. It was unforgivable but to judge all young parents by their example is unfair.

    i think she should be charged with accessory to murder!!!....even though she didnt put her hands on him (that we know of) she was still there and let it happen...and waited 45 minutes to call 911. this disgusts me i cant fathom how anyone who has a child could possibly care so little about their child!!! R.I.P my baby cousin i love you and will miss you forever and always!!
